Sample Case Report: What a Mortgage Servicing Examination Produces

People ask what they get back when we examine a file, and this sample is the answer. It is a complete contract and servicing examination record in which every figure, date and name is fabricated for illustration, so it describes no real homeowner, servicer, creditor or loan. What it shows accurately is the categories of record we assemble and the form our determinations take.

What is in the report

  • The determination. Each element the other side has to establish to enforce the obligation is listed with what the produced record shows and whether that element is substantiated.
  • Conduct after notice. What the servicer did after it was told in writing that specific facts were disputed.
  • The cure trap. Why a homeowner who is told to cure needs to know that the party demanding payment is entitled to receive it.
  • Contract construction and the creditor’s ledger. What the instrument does and does not require the creditor to disclose about what it has already received.
  • Creditor and servicer performance. Where the other side did not meet its own obligations under the contract.
  • The statutory clock. Every written request measured against its response deadline.
  • The charge-by-charge audit. Each fee listed with the authority produced for it.
  • What the homeowner can do with it, whether that is with a housing counselor, an attorney, a regulator or the servicer.

How to read it

Each row states what was requested and what the produced record does and does not establish. Whether a party is ultimately entitled to enforce is a question for a court or a regulator. The report records what the paper substantiates today, which is the part a homeowner, a counselor or an attorney can act on.

The sample is a mortgage file, and it was written with housing counseling agencies in mind as well as homeowners. We use the same element-by-element method when we examine an auto loan, a debt placed with a collector or a title record.
